Terms and Conditions

Hospitality, trust, and personalized service are central to the hospitality industry’s core mission. Guests expect not only value commensurate with the price they pay, but also an extra measure of courtesy, service, and ambiance. We always strive to meet this desire for additional, mostly intangible services. Despite this special relationship between the hotelier and their guests, however, the same legal principles and rules apply as in any other legal or contractual relationship. To address the need for information on this matter and to clear up any misunderstandings, here is our lodging agreement.

1. Scope

These Terms and Conditions apply to events held in the restaurant and in the hotel’s event spaces, to room reservations, and to all other related services and supplies. They also apply accordingly to other spaces, display cases, walls, and other surfaces made available by the hotel. 

2. Conclusion of the Contract/Contracting Parties 

2.1.

The hotel's offers are always subject to change. The hotel will confirm to the contracting party that the contract has been concluded by sending a confirmation of the offer via email. The hotel’s confirmation of the offer contains the text of the contract, including the General Terms and Conditions, and is legally binding as it is signed by the hotel. The contract is then concluded upon the guest’s/customer’s confirmation of the offer by signing it. The hotel and the guest/customer are the contracting parties.

2.2. If the guest/customer is not the event organizer itself, or if the event organizer engages a commercial agent and organizer, the event organizer shall be jointly and severally liable with the guest/customer for all obligations arising from the contract, provided that the hotel has received a corresponding statement from the event organizer. 

3. Services 

3.1. Reserved guest rooms or event spaces are available to the guest/customer only during the time period agreed upon in writing. Use of the spaces beyond the specified time period requires prior arrangement. Confirmation of the reservation does not entitle the guest/customer to specific guest rooms or event spaces. 

3.2. Reserved guest rooms are available to guests on the day of arrival starting at 2:00 p.m. and on the day of departure by 10:00 a.m. from Monday through Friday, and by 11:00 a.m. on Saturdays, Sundays, and holidays. If guests stay longer than scheduled, the hotel reserves the right to charge a 40% surcharge.

4. Cancellation Policy 

In the event of cancellation of a reservation for guest rooms and/or event spaces, cancellation fees are generally payable. 

4.1. Cancellation of a confirmed room reservation or a rented room: 

  • Up to 2 weeks before the arrival date, 20% of the agreed-upon price is due. 
  • Up to 1 week before the arrival date, 50% of the agreed-upon price is due. 
  • If cancellation occurs less than one week before the arrival date, 80% of the agreed-upon price will be charged. 
  • If you do not arrive and have not canceled in advance, you will be charged 100% of the agreed-upon price. 

4.2. Cancellation of Events, Seminars, and Other Celebrations: 

A 50% cancellation fee applies up to 4 weeks before the event date. 

If cancellation occurs less than 2 weeks before the event date, a 100% cancellation fee will apply. 

Cancellation fees are calculated based on the order or service contract. The calculation is based on 75% of the ordered or agreed-upon food sales and €25.00 per person for beverages. In addition, any ordered services—such as flowers, fireworks, entertainment, etc.—are charged at cost. 

4.3. Exceptions In the event of a verifiable death in the immediate family (first degree), Hotel Schloss Rabenstein will charge only cancellation fees equal to the actual cost price for family celebrations such as weddings, birthdays, etc. 

5. Duty to Disclose Information 

5.1. Group Travel 

To ensure that room or group reservations for 10 or more people run smoothly, the guest or person making the reservation must provide the hotel with a complete list of names no later than 7 days before the group’s arrival. 

5.2. Seminars, Events, and Celebrations 

When reserving event spaces and catering services, the guest/customer must provide the hotel with the exact number of guests no later than 7 business days before the start of the event. Up to 24 hours before the start of the event, we will accept a reduction in the agreed-upon number of guests of up to 10% free of charge. If the reduction is made later and/or exceeds 10%, the services will be billed in full. 

6. End of the event 

If an event ends after 11:00 p.m., a flat-rate surcharge of €100.00 will be charged for each hour or portion thereof. 

7. Damages 

The guest/customer is liable for any damage to or loss of furnishings or inventory that occurs during a stay, and it is presumed—subject to rebuttal—that such damage or loss was caused by or attributable to event participants. The display of decorative materials or other items is not permitted without the hotel’s consent. 

The hotel assumes no liability for damage to or loss of personal belongings or exhibits brought onto the premises, except in cases of willful misconduct or gross negligence. The guest or the person making the reservation is responsible for obtaining any necessary insurance for personal belongings brought onto the premises. All decorative materials brought onto the premises must comply with fire safety regulations. 

8. The Hotel's Obligations 

Any malfunctions in the technical or other equipment provided by the hotel will be remedied immediately. This does not give rise to any claims for withholding payment or a reduction in the amount owed by the guest or the person making the reservation. 

9. Use of Pyrotechnics

The use of pyrotechnics (including sparklers, smoke machines, or other fireworks) is expressly prohibited for the contracting party. The hotel may grant an exception provided that the contracting party presents proof of an appropriate insurance policy (liability insurance). The contracting party is liable for the remaining amount, which covers the difference between the insurance payout in the event of damage and the replacement value of the damaged item.  

10. Right of Withdrawal 

If a political event is held without written consent, or if there is reasonable cause to believe that the event threatens to disrupt the smooth operation of the business, compromise the safety, or damage the reputation of our hotel or our guests, as well as in cases of force majeure, the hotel may terminate the contract without compensation. 

11. Food to Bring and Take Home

11.1. Bringing in food and beverages is permitted only with the hotel’s prior written approval. If guests bring in homemade cakes, etc., the hotel shall not be held liable for any personal injury or property damage. The hotel reserves the right to request that the guest or person placing the order provide samples of the food and beverages brought in, free of charge, for testing. The hotel reserves the right to charge a corresponding service fee. 

11.2. If you wish to take home leftover food from the buffet or catering service, the following provisions apply: You take the food home at your own risk. Food may spoil significantly faster due to the passage of time, transportation, or a break in the cold chain. Accordingly, the hotel assumes no liability for the food’s shelf life or quality once it has been handed over to you.

12. Terms of Payment 

12.1. For private events and overnight stays, invoices must be paid in full immediately after the event ends or on the day of departure. Companies, institutions, etc., will receive an invoice, which is payable in full within 14 days. 

The hotel reserves the right to require the guest or the person making the reservation to pay a deposit equal to the expected total revenue prior to the start of the event. 

12.2. All prices listed are in euros. We do not accept foreign currency. Our prices are final and generally include the statutory value-added tax. The hotel reserves the right to increase prices depending on market conditions and costs. 

13. Musical Entertainment 

Musicians’ and artists’ fees are either settled directly with the guest/client or billed to the guest/client through the hotel. The hotel reserves the right to settle or invoice musicians’ and artists’ fees in advance. Any GEMA fees that may apply are the responsibility of the guest/client. 

14. Lost and Found 

Lost items will be forwarded only upon request and at the guest’s own risk, and a fee will apply. Otherwise, after a one-month holding period, the items will be turned over to the local lost and found office or a nonprofit organization. 

15. Final Provisions 

15.1. Any deviating agreements or ancillary agreements must be in writing to be valid. 

15.2. The place of performance and venue for legal proceedings is Chemnitz. 

15.3. Should any individual provisions of these General Terms and Conditions be or become invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply.
